Working of Megan’s Law and Sexual Crimes in Georgia

Augusta GA Sex Crime Defense Lawyer

Megan’s law informs people in a community if a potentially dangerous sex offender shifts into their neighborhood. The method and details that would be communicated to residents vary from state to state and even from community to community within the same state. However, due to the system that Megan’s Law has imposed, every state keeps track of sex offenders and their area of residence.

Depending on the state the kind of information given out varies. There are online databases where information about sex offenders can be found out using zip code. These databases carry information about offender, his crimes and last committed crime as well as other general information such as address etc. Photographs are also provided at times in these databases. In many places, one needs to approach the designated police station where they are allowed to access sex offender database. There are some states which make it mandatory to for sex offenders to place signs in windows of their houses. Some states pass on sex offender information to schools and neighbors so that they are aware of the person staying amidst them.

Megan’s law is named after seven year old Megan Kanka who was kidnapped, sexually assaulted and killed by a person who had a criminal history of conviction for sexual offenses. This person had moved into the neighborhood and nobody was aware of his criminal history or convictions.

There are many downsides to this law but in light of the safety that this law offers the people of a community, these can be ignored. There have been many challenges to the registration and notification laws of sex offenders but none of them have met with any success. The benefits to society outweigh the down side of these laws.

The most common effect of Megan’s law has been vigilantism. When a sex offender moves into a new neighborhood, the people are notified and this awareness, bring them together to take actions to drive him out of the neighborhood and in many cases even cause physical harm. Though vigilantism is not a common occurrence it is a grave possibility and threat that sex offenders face throughout their life outside prison.

Another more grave issue is that due to stigma attached to sex offender registration and notification, sex offenders do not comply with registration laws and procedures or they try to avoid them at all costs. A typical felony case can be registered if sex offender does not register his residence but this registration requirement is neglected in majority of cases.

Being aware of anti social elements like sex offenders in you locality is a right that common innocent people have. Megan’s law helps protect our young from such offenders.
